REHABILITATION AND MEDICAL TREATMENT AFTER A MOTOR VEHICLE ACCIDENT IN NSW

Being injured in a motor vehicle accident is an overwhelming, stressful and life-changing experience. Beyond the shock of the incident itself, injured people often face questions about medical treatment, recovery time, and how their rehabilitation will be funded. In New South Wales, the Motor Accident Injuries Act 2017 (NSW) provides a pathway for injured people to access rehabilitation and treatment as part of the compulsory third party (CTP) insurance scheme.

At Advantage Legal, we place rehabilitation at the centre of every case. Compensation is important but ensuring clients get the right treatment and care from the outset is what helps them return to health and independence. In this edition of ‘Compensation Insider’ we’ll cover how to access treatment following an accident, the importance of early intervention rehabilitation and treatment, dispute resolution avenues when an insurer denies treatment and how the right lawyer can assist you.

WHAT HAPPENS IMMEDIATELY AFTER AN ACCIDENT?

The first step following an accident is to seek prompt medical care. Attending a hospital or general practitioner is not only critical for health but also creates a record of injuries that may later support a CTP claim. Prompt treatment helps prevent conditions from worsening and ensures the insurer is aware of all of the injuries that have been sustained in the accident.

It is important to note that insurance companies will only approve treatment for injuries sustained in the motor accident. It is therefore of critical importance that you report every injury sustained in the accident, no matter how minor or trivial. This helps reduce disputes at a later stage if treatment is required.

ACCESSING MEDICAL AND REHABILITATION TREATMENT

Under the NSW CTP scheme, injured people can usually access:

  • Hospital treatment and surgery if required
  • GP and specialist consultations
  • Allied health services, such as physiotherapy, psychology, and exercise physiotherapy
  • Pharmaceuticals, aids, and equipment to assist recovery

Treatment must generally be reasonable and necessary and required as a result of the injuries sustained in the motor accident. In practice, this means it needs to be related to the accident, supported by medical evidence, and likely to improve the person’s health or ability to function.

Outside of emergency treatment in hospital and initial consultations with your GP, it is essential that all treatment be pre-approved by the CTP insurer. Failure to do so may leave you out of pocket in circumstances where the insurer disputes that the treatment.

EARLY REHABILITATION AND SUPPORT

One of the most beneficial aspects of the scheme is that it funds early intervention. For many people, rehabilitation starts within weeks of the accident. Common examples include:

  • Radiology such as X-rays, CT scans or MRIs to help diagnose the extent of an injury.
  • Surgery for injuries not addressed in hospital in the immediate aftermath of the accident.
  • Physiotherapy to restore mobility and strength
  • Psychological counselling to address anxiety, depression, or post-traumatic stress symptoms
  • Occupational therapy to support return to daily activities or work
  • Exercise programs designed to aid long-term recovery

Getting treatment approved quickly can reduce complications and speed up recovery. Advantage Legal works closely with treating providers and insurers to push for fast approvals so that rehabilitation is not delayed.

WHAT IF THE INSURER REFUSES TREATMENT?

Sometimes insurers deny or limit treatment, arguing it is not “reasonable and necessary.” This can leave injured people frustrated and anxious. In these situations, a lawyer can:

  • Challenge insurer decisions and request internal reviews
  • Gather supporting medical evidence to justify treatment
  • Escalate disputes to the Personal Injury Commission, if needed

Having legal support ensures clients do not miss out on treatment they genuinely need.

LONG-TERM REHABILITATION AND RETURN TO WORK

For some injuries, rehabilitation is not a matter of weeks but months or even years. A tailored rehabilitation plan might include:

  • Vocational rehabilitation to help return to work or re-train in a new role
  • Home modifications or equipment to support independence
  • Long-term psychological support for ongoing mental health conditions

Insurers may also cover domestic assistance such as cleaning, shopping, or lawn mowing if an injured person cannot manage these tasks during recovery.
